Our Non-Court ApproachOur law practice is centered on the settlement approach to divorce. More precisely, our law practice is centered on helping our clients to achieve early settlements in their divorce cases. It is a well accepted fact that over 90% of all divorcecases settle before reaching trial. Many settle on the courthouse stairs just prior to trial and many settle at other advanced stages. But too few cases settle early on – before the parties are called upon to spend large sums of money. Going to court should be the alternative way of resolving divorce cases. It should not be the norm.Upon entering the legal system, spouses are required to see each other as opponents. That has always been our tradition in all fields of law - and no exception is made for divorce cases. Whenever opponents are involved,winning – and not settlement - is the only priority. Settlement cannot be a priority unless someone makes it one, and that is what we do. We believe that the parties are better served if they and their attorneys focus their energies on early settlement rather than on preparing for a trial that, statistically at least, is not going to take place. Spouses that have the willingness and ability to compromise should not be herded into the same system as those who choose to go to battle. At the very least, those who have the tools to get divorced in a friendly or mature fashion should get all the help and encouragement that they might need to do so. They should have a special path cleared just for them. In a good divorce, a family with children will remain a family.That path is known as alternative dispute resolution: mediation and its new counterpart, collaborative divorce law. The fact is that these methods are so effective, speedy and inexpensive, that our traditional divorce legal system should be referred to as the alternative dispute resolution method – and not the other way around! |
